Terms of Service

Effective date: 18 June 2026. Please read these Terms of Service (“Terms”) carefully before using Culture Cave or placing an order. By accessing the site, creating an account, or purchasing any product, you agree to be bound by these Terms. If you do not agree, do not use the site.

1. Who we are

Culture Cave (“Culture Cave”, “we”, “us”, or “our”) operates an online marketplace at culturecave.store that connects independent third-party vendors (“Vendors”) with customers (“you”). Culture Cave is based in the State of Colorado, United States. Individual products are sold and shipped by the Vendor identified on the listing; Culture Cave provides the platform that hosts those listings.

2. Eligibility and age requirement

You must be at least 21 years of age and legally permitted to purchase the products in your jurisdiction to use this site or place an order. By ordering, you represent and warrant that you meet this requirement. We may refuse, cancel, or limit any order at our sole discretion, including where we believe an order is placed by a minor or in violation of these Terms or applicable law.

3. Microscopy and research use only

All mushroom spores, spore syringes, spore prints, spore swabs, liquid cultures, agar cultures, and genetic material offered through Culture Cave are sold strictly for legal microscopy, taxonomy, identification, research, and educational purposes only. They are not sold for, and must not be used for, the cultivation, production, or manufacture of any controlled substance, nor for human or animal consumption.

4. No cultivation and no consumption

You expressly agree that you will not use any product purchased through Culture Cave to germinate, cultivate, grow, produce, or manufacture mushrooms or any controlled substance, and you will not ingest or consume any product. By placing an order you covenant that your intended use is lawful and limited to the microscopy, research, and educational purposes described above. Any statement by you to the contrary, or any request for cultivation or consumption guidance, may result in cancellation of your order and termination of your account.

5. Products we do not sell

Culture Cave and its Vendors do not offer, and you may not attempt to purchase through the platform, any of the following: live or dried psychoactive (psilocybin-containing) mushrooms or fruiting bodies; “fruit clone” or fruiting-body-derived cultures of psychoactive species; fully colonized “ready-to-fruit” bags, colonized or inoculated grain spawn, or colonized substrate of psychoactive species; or any product that itself contains a controlled substance. Listings are limited to lawful items such as spores for microscopy, permitted culture material, cultivation equipment and supplies for lawful gourmet/medicinal use, and gourmet or medicinal (non-psychoactive) mushroom products.

6. Restricted shipping locations

We do not ship to California, Idaho, Georgia, or Florida. Orders with a billing or shipping address in any of these states cannot be accepted and will be blocked at checkout or cancelled and refunded. We may add or remove restricted locations at any time to comply with changing law. We do not ship internationally except where expressly offered, and any international order is placed at the buyer’s risk and subject to the destination country’s laws.

7. Compliance with laws — your responsibility

Laws governing mushroom spores, cultures, and related products vary by state and country and change frequently. It is your responsibility to know and comply with the laws of your own jurisdiction before ordering. You are solely responsible for your possession and use of any product after delivery. Nothing on this site is an inducement or invitation to break the law, and our “microscopy and research use only” restriction is a condition of every sale.

8. Vendors and the marketplace

Vendors are independent businesses responsible for their own listings, product descriptions, inventory, fulfilment, and compliance. Culture Cave is not the manufacturer or seller of record of Vendor products and does not guarantee any Vendor’s products or conduct. Vendors must comply with these Terms and our vendor policies, including the prohibited-product and marketing rules; we may remove listings or suspend Vendors that do not.

9. Orders, pricing, and payment

All prices are shown in the currency stated on the listing and may change without notice. We strive for accuracy but do not warrant that product descriptions, pricing, or other content are error-free, and we may correct errors, cancel affected orders, and issue refunds. Payment must be completed through the methods offered at checkout. We may use third-party payment processors, and your use of those services is subject to their terms.

10. Shipping and delivery

Shipping is handled by the Vendor or its carrier. Delivery times are estimates only. Risk of loss passes to you on delivery to the carrier. You are responsible for providing an accurate, complete, and lawful delivery address that is not within a restricted location.

11. Returns and refunds

Returns and refunds are governed by our Refund and Returns Policy, which forms part of these Terms. Because of the perishable and sensitive nature of the products, many items are non-returnable; please review the listing and policy before ordering.

12. Acceptable use

You agree not to misuse the site, including by attempting to circumvent the age gate, restricted-location controls, or prohibited-product rules; providing false information; or using the site for any unlawful purpose. We may suspend or terminate access for any breach of these Terms.

13. Disclaimers

The site and all products are provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law. Nothing on this site constitutes legal, medical, or professional advice. We make no representation that any product or its use is legal in your jurisdiction.

14. Limitation of liability

To the fullest extent permitted by law, Culture Cave and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use or misuse of any product, your breach of these Terms, or your violation of any law. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

15. Indemnification

You agree to indemnify and hold harmless Culture Cave and its Vendors, officers, employees, and affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your use of the site or products, your breach of these Terms, or your violation of any law or the rights of any third party.

16. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the site will be subject to the exclusive jurisdiction of the state and federal courts located in Colorado, unless otherwise required by applicable law.

17. Changes to these Terms

We may update these Terms at any time. Changes take effect when posted on this page with a revised effective date. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.
