The federal position
As of 2026, mushroom spores are not controlled under United States federal law. The Controlled Substances Act lists psilocybin and psilocin. It does not list the spores of the fungi that can produce them, and a spore contains neither compound. That is why spore syringes and spore prints of Psilocybe cubensis are sold openly across most of the country, provided they are sold for microscopy and taxonomy use.
Two things remain illegal under federal law: possessing psilocybin mushrooms, and cultivating them. Germinating a Psilocybe spore is the moment a legal product becomes an illegal act. This guide is not legal advice. Laws change and local rules vary, so check your own state before you buy.
Mushroom spores legal states: the three exceptions
Most states follow the federal line and say nothing specific about spores. Three states do not. As of 2026, California, Georgia and Idaho prohibit Psilocybe spores under their own state law. The wording differs between them, but the effect is the same: buying, possessing or shipping psilocybin-producing spores into those states is unlawful, and no reputable vendor will do it.
If you live in one of those three states, the answer to "are spore syringes legal in the US" is no for you, whatever the federal position says. State law reaches you first.
Every other state permits spores for microscopy as of 2026. Statutes get amended, though, so check your state before each order rather than relying on a guide written earlier in the year.
Why vendors refuse to ship to those states
Vendors refuse California, Georgia and Idaho for three reasons.
- The sale itself may be an offence. Shipping a prohibited item into a state can expose the vendor, not only the buyer.
- Payment processors watch for it. A vendor who ships to banned states risks losing the checkout that every other customer depends on.
- It protects the hobby. The microscopy trade exists because it stays inside the law. One careless vendor draws attention to all of them.

The microscopy-only convention
Psilocybe spores are sold for microscopy and taxonomy. That is the lawful use, and it is a genuine hobby. Amateur mycologists compare spore size, shape, colour and ornamentation between species and varieties, and keep records of what they see. The convention has practical rules. A vendor will not give cultivation advice for Psilocybe species, and you should not ask. Listings do not mention yields or potency. Products are labelled with the species or strain, the date and the words "microscopy use only" or similar. A vendor who breaks these rules is a risk to you as well as to themselves. Non-controlled species sit outside all of this. Gourmet cultures such as oyster, lion's mane and shiitake can be grown freely, which is why vendors also sell liquid cultures, agar plates and grow bags.
Decriminalisation does not change the spore rule
Oregon and Colorado have changed their state rules on psilocybin itself, and several cities have told police to treat psilocybin as a low priority. These changes get a lot of coverage, and they cause confusion about spores.
Here is the position. Those reforms concern psilocybin and regulated or decriminalised programmes within a particular state or city. They do not alter federal law, under which cultivation remains illegal everywhere. And they do not alter the spore position, because spores were never controlled in those places to begin with. A spore syringe bought in Colorado, where Culture Cave is based, was legal for microscopy before the reforms and is legal for microscopy after them. Nothing about the reforms makes it legal to germinate that syringe.
Equally, decriminalisation in one city does nothing for a buyer in California, Georgia or Idaho. State prohibition on spores stands wherever it exists.
Buying from US vendors versus international vendors
US vendors
Nineteen of Culture Cave's 29 vendors are based in the USA. Buying domestically means no customs, no import paperwork and transit of a few days by ordinary post or courier. Buying from the UK, Australia or South Africa is possible, but check two things. First, whether the vendor ships to the USA at all, since several do not. Second, how they declare the parcel. Spores are not federally controlled, so customs has no legal basis to seize them, but a vague declaration can cause delay or inspection. Expect longer transit times. International vendors sometimes carry varieties that US sellers do not, which is the main reason to look overseas.
